Food Safety and Standards Authority of India (FSSAI)

The Food Safety and Standards Authority of India (FSSAI) is the apex regulatory body responsible for protecting and promoting public health through the regulation and supervision of food safety in India. Operating under a strict precautionary regulatory model, the FSSAI plays a central role in governing the beverage industry by defining product classifications, setting safety standards, and managing import clearances for global beverage conglomerates like asahi-group-holdings and anheuser-busch-inbev.

ABV Thresholds and Classification

The FSSAI’s regulatory framework is a prime example of abv-threshold-divergence, utilizing a strict four-tier classification system for beverages under the Food Safety and Standards (Alcoholic Beverages) Regulations:

  1. Alcoholic Beverages: Any beverage containing more than 0.5% ABV (provided the ethanol originates from agricultural ingredients).
  2. Low Alcoholic Beverages / Ready-to-Drink (RTD): Flavored beverages containing more than 0.5% but not more than 8.0% ABV.
  3. Non-Alcoholic Counterparts: Beverages with an alcohol content of less than or equal to 0.5% ABV, which must meet all requirements of their alcoholic origin beverage except the ethyl alcohol content.
  4. Alcohol-Free Beer: A distinct category explicitly defined for products with an ABV of exactly 0.0%.

The 2020 Alcohol-Free Beer Ruling

Historically, the classification of alcohol-free beer in India suffered from legal ambiguity, frequently leading to severe shipment clearance delays at ports of entry. To resolve this issue, the FSSAI officially operationalized amendments in June 2020 to define “alcohol-free beer” as strictly 0.0% ABV.

This amendment removed the customs bottleneck and created a clear legal pathway for brands to import zero-alcohol variants. However, despite containing no alcohol, the FSSAI mandates that 0.0% beer must comply with the same safety and quality limits specified for regular beer across all other parameters. While this strict 0.0% mandate eliminates administrative ambiguity, it places a significant operational burden on international NOLO brands exporting to India.

Import Requirements

Importing non-alcoholic beverages into India requires strict compliance with FSSAI mandates. Key requirements for entry include:

  • Obtaining a No Objection Certificate (NOC).
  • Ensuring products have a minimum of 60% of their shelf life remaining upon entry.
  • Providing all mandatory label information in English.

Furthermore, because the FSSAI operates under a precautionary model, it does not automatically recognize US GRAS (Generally Recognized as Safe) status for novel functional ingredients. Any such ingredients require separate, rigorous evaluations under India’s functional-beverage-regulations.
